Terms of Service

1. Acceptance of Terms

By accessing or using ideaflood (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and ideaflood.

2. Description of Service

ideaflood is a SaaS content generation tool that uses artificial intelligence to help social media creators, marketers, and businesses generate content ideas, hooks, outlines, captions, and calls-to-action based on a single content idea or theme provided by the user.

3. User Accounts

To use the Service, you must create an account by providing a valid email address and password, or by authenticating through Google. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 13 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.

4. Subscription and Payments

The Service offers both free and paid subscription plans. The free plan includes 3 content generations per month. The Pro plan is available for a recurring fee (currently $12 per month) and includes unlimited generations.

All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel. Subscription fees are non-refundable except where required by law.

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. We reserve the right to change pricing with reasonable notice.

5. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service or other systems or networks
  • Use the Service to generate spam, malware, or other unwanted content at scale
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or commercially exploit the Service without express written permission

6. Intellectual Property

Our IP: All intellectual property rights in and to the Service — including software, algorithms, designs, text, graphics, and logos — are owned by ideaflood or its licensors. These Terms do not grant you any rights to use our trademarks or branding without prior written consent.

Your Content: You retain all ownership rights to the content ideas you submit and the AI-generated outputs you receive. You may use generated content for any lawful purpose, including commercial use. We do not claim ownership over your inputs or outputs.

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate content suggestions. While we strive for quality and relevance, we do not guarantee the accuracy, appropriateness, or effectiveness of any generated content. You are solely responsible for reviewing, editing, and deciding whether to publish any content created with the Service. ideaflood is not liable for any consequences arising from the use of AI-generated content.

8. Termination

You may stop using the Service and delete your account at any time. We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, all licenses granted to you under these Terms will immediately cease. Sections of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, and limitations of liability.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IDEAFLOOD, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 IF YOU HAVE NOT PAID ANYTHING.

11. Indemnification

You agree to indemnify, defend, and hold harmless ideaflood and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in Delaware, except that either party may seek injunctive relief in a court of competent jurisdiction.

13. Changes to Terms

We may modify these Terms at any time. We will post the updated Terms on this page with a revised “Last updated” date. Material changes will be notified to you via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
